These terms apply to all transactions between Zomorrod, its artists/Partners, and buyers, both B2C and B2B. The Zomorrod may, at any time, revise the terms; continued use after such change constitutes your acceptance.
2. Intellectual Property & Content
All materials on this website, including text, images, artwork, listings, layout, logos, and design, are owned by Zomorrod or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and download content only for personal, non-commercial use unless you obtain Zomorrod’s prior written permission. Any commercial use, copying, reproduction, distribution, modification, or public display is prohibited without express consent.
3. Account Information & Legal Disclosure
You must provide accurate and current information. Zomorrod may access, preserve, and disclose account information, submissions, and communications if required by law or if Zomorrod reasonably believes disclosure is necessary to protect rights, property, safety, or to respond to customer service requests.
4. Terms of Sale (Orders & Contracts)
By placing an order, you are making an offer to purchase under these Terms. Acceptance occurs when the order has been confirmed by Zomorrod. Prices include all stated taxes; shipping and duties are as detailed at checkout. Zomorrod reserves the right to refuse or cancel orders at its own discretion, particularly in cases of price errors, lack of product availability, or suspected fraud.
5. Artists, Consignment & B2B Sellers
Artists and sellers retain copyright in their works, except as expressly transferred in a separate written agreement. Consignment, wholesale, or partnership arrangements are subject to a separate contract. Zomorrod functions as a marketplace and/or selling agent according to the Agreement applicable to it.
6. Delivery & Risk of Loss
Delivery terms and shipping estimates are provided separately on our Delivery page. Title and risk generally pass to the buyer upon handover to the courier, except where otherwise specified in a written agreement. Customs duties, import taxes, and clearance fees are the responsibility of the recipient.
7. Cancellation, Returns & Refunds
Because artworks are unique, returns and cancellations are subject to Zomorrod’s return policy as posted on the site and any artist-specific terms. If returns are accepted, items must be returned in their original condition and packaging within the stated timeframe. Refunds (when applicable) are processed after receipt and inspection and may exclude shipping and handling fees.
8. Payment & Security
Payment must be made by the methods listed at checkout. Zomorrod does not store any full card details on its servers; all payment processing is handled by a third-party payment provider. You hereby authorize Zomorrod to charge your chosen payment method for the order amount and any additional fees.
9. Missing, Damaged, or Faulty Items
Inspect shipments upon receipt. Report missing or damaged items within the timeframe specified in our Delivery/Returns policy. Typically, this is within 48 hours for damage, but this may vary. Claims should include photos and proof of purchase. Zomorrod will, at its discretion, arrange repair, replacement, or refund, subject to policy and any applicable artist/partner terms.
10. Limitation of Liability
To the maximum extent permitted by law, Zomorrod’s liability for any claim related to goods, services, or the site is limited to the purchase price of the item(s) that is/are affected. Zomorrod is not responsible for indirect, incidental, consequential, or special damages, or loss of profit, or delays caused by third-party carriers, customs, Force Majeure, or government actions.
11. Third-Party Links & Services
The website may include links to third-party websites and/or services. Zomorrod does not have any control over, and is not responsible or liable for, the third-party content, product, service, or policies. Access to third-party services is entirely your decision and risk, subject to their respective terms.
12. Electronic Communications
By using the site, you consent to receive electronic communications from Zomorrod (e.g., email). Electronic communications satisfy any legal requirement for written notice.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the country where Zomorrod is incorporated.
